Sample License & Terms

This license applies to every sample, loop, one-shot, multitrack recording and sound library downloaded or purchased from One Man Tribe by Ben Aylon through benaylon.com, samples.benaylon.com or the connected Ben Aylon store. By downloading or purchasing a product, you accept these terms.

1. LICENSE, NOT SALE

The sounds are licensed, not sold. The original recordings and all associated copyrights remain the property of Ben Aylon, One Man Tribe and/or the credited producer or rightsholder. Your purchase gives you a non-exclusive, worldwide and perpetual license to use the sounds under these terms.

2. 100% ROYALTY-FREE STANDARD USE

Except only for the two categories requiring paid clearance in Section 3, the sounds are 100% royalty-free. You may edit, process, combine and incorporate them into your own original musical works and audio, visual or multimedia productions. Permitted uses include independent and commercial music releases, albums, singles, live performances, independent films and videos, podcasts, video games, websites, business presentations, artist promotion and self-produced online content.

You may commercially release and monetize those finished productions and keep the resulting revenue. Under the standard license, no additional royalties, license fees, publishing splits, producer royalties, producer fees or co-production credits are owed to Ben Aylon, One Man Tribe or a credited guest producer.

3. USES REQUIRING PAID CLEARANCE

Major-label releases above four million streams. If the sounds are incorporated into a recording released by or through a major record label, the standard license applies until that specific recording exceeds 4,000,000 combined on-demand audio and video streams worldwide across recognized streaming platforms. Paid written clearance becomes required when the threshold is crossed. The licensee must contact Ben Aylon within 30 days after crossing the threshold, and continued commercial exploitation is subject to the agreed clearance terms.

Feature films and professional company productions. Paid written clearance must be obtained before release, broadcast, distribution or public use when the sounds are used in a feature film or in a production commissioned, financed, produced or released by a film or television production company, studio, broadcaster, streaming platform, advertising agency or brand. This requirement applies regardless of the project’s revenue or audience size.

These are the only exceptions to the 100% royalty-free standard license. Clearance fees, royalties, publishing or producer participation, credit and other terms will be negotiated case by case. Purchasing a pack does not itself grant clearance for the uses listed in this section. Every use that does not fall within these two categories remains 100% royalty-free.

4. WHAT YOU MAY NOT DO

You may not sell, resell, share, upload, distribute, rent, lease, sublicense, assign or otherwise transfer the sounds as standalone audio files or in any form that allows another person to extract or use them as samples. This restriction applies to the original files and to files that have been edited, reformatted, filtered, layered, re-synthesized or otherwise modified.

You may not include the sounds in another sample pack, loop library, sound library, construction kit, preset, patch, sampler instrument, sample-playback product or competing sound service. You may not distribute the sounds separately from a finished audio, visual or multimedia production.

5. SHARING AND SAFEGUARDING FILES

Your license is for you as the purchaser or authorized downloader. Do not share download links, files, access codes or account credentials with another person. You agree to take reasonable care to prevent unauthorized access, copying or distribution and to notify One Man Tribe if you discover misuse.

6. FREE PACKS AND GUEST-PRODUCER PACKS

Unless a product page expressly says otherwise, free packs and credited guest-producer packs available through this store are covered by the same license. The credited producer retains any ownership stated for that product, while you receive the usage rights described here.

7. WEBSITE AND EDUCATIONAL CONTENT

This sample license applies only to the downloadable audio products. Articles, written lessons, ebooks, videos, tutorials, artwork, branding and other website content may not be republished or distributed without prior written permission.

8. ACCURATE INFORMATION AND MANDATORY RIGHTS

You agree to provide accurate information when purchasing or contacting the store. Nothing in these terms limits consumer or other legal rights that cannot lawfully be excluded. The license version supplied or displayed at the time of your download or purchase governs that transaction.
